Introduction
This document (the “Terms and Conditions”) regulates the access to and use of this website, hosted under the domain albuquerquefoundation.pt (hereinafter the “Website”), by visitors (the “Users”).
The ownership and management of this Website belongs to the Fundação Renato de Albuquerque, headquartered at Rua do Centro Empresarial, Edifício 6, 2º, Escritório 13, 2710-693, Sintra, holder of the legal person identification number 516478451 (“Foundation”).
These Terms and Conditions apply to any updates, developments, new tools and/or new features or services available on or made available by the Website, without the need for any further communication or action.
Acceptance and contractual nature of these Terms and Conditions
These Terms and Conditions constitute an agreement between the User and the Foundation, the acceptance and fulfillment of which by the User is an indispensable condition for any access to or use of this Website.
Whenever you access and/or use this Website in any way, you fully accept these Terms and Conditions, as well as the Privacy Policy of this Website. If the User does not accept, even partially, these Terms and Conditions or the aforementioned Privacy Policy, he/she must refrain and immediately cease any and all use of this Website.
Changes
The Foundation reserves the right to change these Terms and Conditions at any time, limiting itself to making the changes and publishing them on the Website, and it is the sole responsibility of the User to verify and comply with them at all times. Use of the Website following the posting of changes constitutes acceptance of the updated wording of the Terms and Conditions.
Preconditions
Access to and browsing of the Website is free of charge and does not require registration. However, both the scheduling of visits as well as the carrying out of transactions through this Website and/or the means provided or indicated therein, is limited to adults or Users who, being at least 16 years of age, have been previously and duly authorized by their parental/legal guardian.
Website Availability
The User is responsible for ensuring that he/she meets, at all times, all the technical and security conditions necessary to access and use the Website.
The Foundation does not guarantee the compatibility of the Website with the devices or equipment used, navigation, security or privacy settings, browsers or operating systems used and, in general, the software, hardware or firmware of the User, nor for the operation, adequacy or security of such devices, software and the data stored therein.
It is the User’s responsibility to ensure that they have secure, appropriate and up-to-date equipment, devices, software and networks, both to access and communicate with the Website, and to prevent and neutralize any actions of third parties. The User must also have an electronic communications service that allows the sending and receiving of data via the Internet, the costs of which will be borne by the same.
Access to and operation of the Website, and/or any areas, functionalities, content and/or services made available therein, may be suspended, interrupted or hindered, in part or in full, temporarily or permanently, including, but not limited to, by decision of the Foundation, as a result of errors or failures in the Website and/or in communication with it, during or for the purpose of carrying out maintenance or migration operations, for security reasons, and, in general, for any technical or commercial reasons or difficulties. The Foundation assumes no obligation regarding the maintenance and provision of the Website, and its functionalities, services and contents.
The Foundation reserves the right to change, interrupt, block, suspend, cancel or restrict, partially or totally, at any time and without prior notice, the access, use and/or operation, partially or totally, by one or more Users, of the Website, and/or any areas, functionalities, services or contents thereof.
The Foundation shall therefore not be liable for the partial or total, temporary or permanent unavailability of the Website, nor for difficulties or errors in its operation, including, but not limited to, as a result of a decision to suspend, block or restrict the User’s access.

Unless expressly stated otherwise, the content and information available on this Website, including on products and services, are indicative in nature only, subject to confirmation, validation and/or changes
The Foundation does not guarantee that there are no inaccuracies and/or inaccuracies in the contents of the Website, that the information contained therein is complete and up-to-date, and/or that it is appropriate to the purposes, needs and/or requirements of the Users. The Foundation also cannot guarantee the full and uninterrupted availability of the contents and information contained in the Website, namely in the event of maintenance operations, computer or communications failures, and/or acts of third parties.
The User is solely and exclusively responsible for the use made of the Website and its contents, including, but not limited to, the analysis, evaluation and use of any information contained in or obtained through it, and, in particular, for the verification and confirmation of such information through other sources. The User acknowledges and accepts that the Foundation is not, and will not be liable under any circumstances, for inaccuracies or errors in the contents of the Website, nor for any damages resulting therefrom.
The User acknowledges that the copying or downloading of any content or files available on this Website, even when permitted, is carried out at the user’s own risk, assuming full responsibility for any damage caused to computers, devices, networks, systems and/or computer programs, his/her, the Foundation’s and those of third parties, including, but not limited to, unavailability and/or loss or corruption of data resulting therefrom. The User is also responsible for ensuring the conservation, confidentiality, security and accessibility of any content or files that he/she has copied or downloaded, and, for this purpose, he/she must ensure that he/she selects the folder(s) or space(s) on his/her equipment or device where he/she keeps or to which he/she downloads and saves the information.
Links. In order to facilitate the User’s accessibility, the Foundation may include third-party content as well as links to websites external to the Website. The Foundation is not responsible for such content and websites, including their correctness, timeliness and/or availability, and the User is therefore solely responsible for their access and use.
Transmission of information
Where applicable, the selection of buttons and boxes, the completion of fields and the submission of any information or documents through the Website constitute, for all purposes, declarations by the User, binding him/her in the same terms as written or verbal declarations. To this end, the User undertakes to fill in only fields and/or select buttons and boxes relating to the knowledge and agreement of the same after carefully analysing the information received and confirming that they have all the elements they consider relevant to their decision.
The User is solely responsible for the veracity, correctness, completeness and timeliness of all the information and documentation that he/she enters, uploads and/or sends through the Website, including forms or email addresses indicated therein, as well as for the correct selection of fields and options related to the actions, transactions, products and services sought, and undertakes to carefully review all the elements that he/she inserts and are presented to him/her and to promptly correct any errors or non-conformities in this information and/or in the options you have configured before proceeding with any operation.
Booking visits
The Foundation allows, in accordance with the conditions in force at any given time, the visit and access to the Albuquerque Collection of Chinese Ceramics (“Collection”) and other permanent or temporary exhibitions exhibited in its facilities located at Quinta de São João (“Museum”), including, as applicable, to the respective spaces, equipment and museum and non-museum services, such as the library, the gardens, the shop, the terrace café, the residences and outdoor and parking areas.
For this purpose, Users may purchase and sell tickets (individual or group):
- Through this Website (https://albuquerquefoundation.pt/) or the BOL Online Ticket Office (https://www.bol.pt/).
- Through this form or by communication to the email [email protected], for requests to schedule visits for groups (with a limit of 20 people) (at least 10 days in advance of the desired date).
- Directly at the Foundation’s physical ticket office, in the case of the purchase of individual tickets for members of groups of more than 10 people.
Intermediaries and service providers
The purchase of tickets through this Website or at the BOL Online Ticket Office is ensured by a third party (hereinafter referred to as “BOL”), who is responsible for ensuring and managing, through its own platform and software, the entire process of electronic ticket transactions, including with regard to communication with the User, the issuance of invoices, and the processing of payments, and whose identity is as follows:

The carrying out of transactions through this Website also implies the intervention of other third parties, such as:

- RNA Seguros, S.A., in the case of subscription by the purchaser of the BOL Ticket Insurance, described and regulated in the General and Special Conditions, in the Information Document on BOL Ticket Insurance and in the Frequently Asked Questions on the BOL website.
Conditions applicable to the purchase and sale of tickets online
The purchase of tickets through this Website or the BOL Online Ticket Office implies the full and unequivocal acceptance by the User, in addition to these Terms and Conditions and the Privacy Policy of this Website:
- The Albuquerque Foundation’s Digital Policy regarding the purchase and sale of tickets online and the processing of personal data of purchasers, available here
- The General Conditions of Sale and the Privacy Policy of the BOL Online Ticket Office.
The visit and access to the Collection and/or the Museum are also regulated by the Museum’s Regulation and the Foundation’s Personal Data Processing Policy, available for consultation at the Foundation. Please refer to the Albuquerque Foundation’s Digital Policy for more information on the process of buying and selling tickets online and, in particular, on the right of free revocation.
Duties of the User
By accessing, browsing or using the Website, the User undertakes to:
- Not to use the Website for purposes other than those for which the Website is intended, including illegal purposes, contrary to good faith and public order.
- Not to access any section of the Website, other systems or networks connected to or the services offered through the Website, by means of hacking, forgery or any other illegitimate means.
- Not to cause damage to the physical and logical systems of the Foundation or its partners, nor to introduce or spread viruses on the computer network.
- Not to violate the security or authentication measures of the Website or any connected network, or the security and protection measures inherent to the content offered on the Website, including not scrapping or crawling the Website and/or its contents.
- Not to use the Website to collect personal data from other Users.
- Not to take any action that causes a disproportionate, unjustified and unnecessary saturation of the Website’s infrastructure or the Website’s network systems, as well as the network systems connected to the Website.
The Foundation reserves the right to suspend, modify, restrict or interrupt, temporarily or permanently, access, browsing, use, hosting and/or transfer of the content and/or use of the Website’s services, regardless of prior notification, in relation to Users who violate any of the provisions of the Terms and Conditions. The User who does not comply with the Terms and Conditions may additionally be held liable under the terms of the applicable law.

In addition to the provisions of the law and the Privacy Policy and the Digital Policy of Fundação Albuquerque, the User has the right to:

Intellectual property
The User acknowledges and accepts that the Website, as a whole and as an artistic work, is protected as copyright, under the terms of the applicable legislation, and that all trademarks, trade names or logos, the contents and other elements of this Website, as well as any and all rights relating to and over them (hereinafter “Intellectual Property”) are the exclusive property of the Foundation and/or third parties from whom the Foundation has obtained the necessary licenses or authorizations
Access to the Website, even if under the terms set forth in these Terms and Conditions, does not constitute or confer on the User any license or right to use, modify, exploit, reproduce, distribute or publicly communicate any Intellectual Property.
Any use or exploitation of the Intellectual Property by the User is therefore subject to the prior and express authorization of the Foundation. The User may also not remove, ignore or manipulate the symbols or expressions contained in the Website related to the indication of the existence of copyright and/or industrial property rights (“Copyright”, © “Copr.”, “TM”, “Trademark”, among others), as well as any other notices or any information or protection mechanisms that may contain the protected contents, including, for example, mentions of the protection or confidentiality of content.
Non-responsibility of the Foundation
Without prejudice to the provisions of the Law, the Foundation does not assume any responsibility:
- For limitations, failures, or difficulties in the operation of the Website, including in the availability, accessibility and/or performance of the Website and/or any features, services and/or content.
- By acts of third parties, namely, any acts that constitute an illegal or unlawful practice carried out online or on equipment, such as computers, tablets, mobile phones or computer networks, such as, and for example, computer forgery, payment card fraud, damage to computer programs or data, computer sabotage, interception of communications, data theft, or illegitimate access.
- For errors or failures in communications, network and Internet services, and, more specifically, in the transmission and/or reception of communications.
- For the availability, correctness, completeness, timeliness and adequacy of any content and information contained in the Website and/or links mentioned therein.
- For damage caused as a result of the deletion, corruption or error in the storage, sending, reception, copying and/or downloading of content or other data.

Final provisions
- These Terms and Conditions do not affect the User’s rights under the law.
- In the event of a conflict between the Terms and Conditions and other specific provisions on the Website, these shall prevail according to the applicable specifics.
- The failure of the Foundation to exercise or immediately enforce rights or provisions shall not be construed as a waiver thereof.
- The invalidity, declared by a final and unappealable judgment of any clause of the Terms and Conditions does not determine the invalidity of the others, and the Foundation reserves the right to make the necessary changes to the Terms and Conditions in order to remedy the invalidity.
- These Terms and Conditions are governed by Portuguese Law.
All disputes arising from these Terms and Conditions or related to them shall be submitted to the exclusive jurisdiction of the Judicial Court of the District of Lisbon West.
